Website Terms of Use & Binding Acceptance
Welcome to albowa.com (the “Website”), operated by ALBOWA Autonomous Pipeline Intelligence Corp. (“ALBOWA”, “we”, “us”, or “our”). These Terms & Conditions (“Terms”) constitute a legally binding agreement between you—whether individually or on behalf of an entity, municipal authority, utility concessionaire, or commercial enterprise (“User”, “Client”, or “you”)—and ALBOWA regarding your access to, browsing of, and interaction with this Website.
By accessing, browsing, scraping, linking to, or interacting with any portion of this Website, you acknowledge that you have read, understood, and irrevocably agree to be bound by all of these Terms. If you do not agree with any part of these Terms, you are expressly prohibited from using the Website and must immediately discontinue access. We reserve the unilateral right to update, modify, or amend these Terms at any time without prior individual notice; revisions become effective immediately upon publication on this URL.
Intellectual Property Rights & Prohibited Activities
Unless otherwise explicitly indicated, the Website in its entirety—including source code, databases, client-side algorithms, interactive WebGL shaders, 3D animated components, video scrubbing engines, audio simulations, graphics, visual designs, user interfaces, corporate trademarks, service marks, logos, and written technical copy—is the exclusive proprietary property of ALBOWA, protected under international copyright, trademark, trade secret, and intellectual property laws.
You are granted a strictly limited, revocable, non-exclusive, non-transferable license to access the Website solely for internal informational evaluation of ALBOWA pipeline inspection capabilities. Under no circumstances may you:
- Extract, harvest, scrape, or index any data, code, or media using automated bots, crawlers, scrapers, or AI model training pipelines without prior written consent from ALBOWA.
- Reverse engineer, decompile, disassemble, or derive source code or mathematical models from any interactive telemetry demos or visualization frameworks on this Website.
- Circumvent, disable, or tamper with security-related protocols, rate-limiting systems, or headers implemented across our web infrastructure.
- Transmit any denial-of-service (DoS/DDoS) payloads, worms, trojans, automated form spambots, or malicious scripts.
Website Information Disclaimers & "As-Is" Provision
All materials, technical metrics, visual demonstrations, interactive diagrams, and performance thresholds displayed on this Website—including but not limited to claims of 0.02 L/min acoustic sensitivity, 30 bar pressure ratings, and 100+ mile survey endurance—are published strictly for informational, educational, and marketing evaluation purposes.
These figures represent calibrated laboratory benchmarks and controlled pilot trials. Real-world pipeline telemetry, acoustic propagation speeds, and hydrodynamic behavior vary based on internal tubercolosis, sediment deposition, hydraulic transient shocks, line geometry, and fluid viscosity. Nothing published on this Website constitutes a formal engineering guarantee, regulatory certification, or binding contractual warranty.
Commercial Survey Inquiries & Booking Protocols
Submissions initiated through the "Book a Survey" portal, contact forms, or email correspondence do not constitute an executed contract, operational deployment commitment, or pipeline mobilization order. All commercial field inspection services are strictly contingent upon:
- Pre-mission hydraulic engineering assessment and pipe network feasibility verification by ALBOWA technical directors.
- Mutual execution of a formalized Master Services Agreement (MSA) and site-specific Statement of Work (SOW).
- Verification of utility network access points, extraction chambers, and field safety protocols.
Insertion & Hydrodynamic Tolerances
ALBOWA inspection spheres are neutrally buoyant (1.000 ± 0.002 g/cm³) and propelled solely by fluid flow in pressurized water transmission and distribution networks without requiring pipeline de-pressurization or customer service shutdowns.
- Operating Pressure Envelope: Hydrostatically certified up to 30 bar (435 psi / 300m hydraulic head).
- Pipe Diameter Range: Operational inside conduits from 70 mm (Micro Sphere) and 100 mm to 1,800 mm (Standard Sphere).
- Flow Velocity Envelope: Requires a minimum sustained flow velocity of 0.3 m/s (0.98 ft/s) and a maximum design transit speed of 2.8 m/s (9.2 ft/s).
Acoustic Calibration & Detection Thresholds
Under nominal acoustic speed-of-sound operating conditions across certified substrates (Ductile Iron, Cast Iron, PCCP, Welded Steel, HDPE, PVC, and Asbestos Cement), ALBOWA tools achieve verified leak sensitivity down to 0.02 L/min at line pressures ≥ 2.0 bar.
Spatial localization accuracy of acoustic anomalies is calibrated within ± 0.5 meters of physical pipeline chainage, provided the Client supplies verified synchronized surface tracking synchronizations and GIS centerline stationing. Extreme air entrainment, excessive cavitation noise, or severe localized churn may affect acoustic detection bounds.
Utility Infrastructure Access & Field Obligations
To ensure safe mission execution and uninterrupted tool retrieval, contracting utility clients covenant to provide:
- Access Infrastructure: Certified hot-tap launch ports (minimum 2-inch or 4-inch ball valve entry) and downstream extraction catchers/cage chambers.
- Hydraulic Profile Data: Historical pressure data, inner pipe diameter schedules, flow velocity telemetry, and valve position maps prior to tool insertion.
- Personnel Coordination: Designated utility field personnel present at extraction chambers during transit windows to supervise hardware retrieval.
Potable Water Certification & Sanitization
ALBOWA unconditionally warrants that all autonomous tools deployed into potable municipal water infrastructure comply with NSF/ANSI Standard 61 (Drinking Water System Components — Health Effects) and WRAS (Water Regulations Approval Scheme) standards.
Disclaimers, Liability Caps & Comprehensive Indemnification
Website Liability Exclusion: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ALBOWA, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, CONSEQUENTIAL, INCIDENTAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES—INCLUDING LOSS OF PROFITS, LOSS OF REVENUE, LOSS OF REPUTATION, LOSS OF DATA, BUSINESS INTERRUPTION, PIPELINE REMEDIATION COSTS, OR SYSTEM OUTAGES—ARISING OUT OF OR CONNECTED WITH YOUR USE OF, OR INABILITY TO USE, THIS WEBSITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
FOR WEBSITE VISITORS, ALBOWA’S TOTAL AGGREGATE LIABILITY ARISING FROM ANY CLAIM RELATED TO THIS WEBSITE SHALL UNDER NO CIRCUMSTANCES EXCEED $100.00 USD. FOR EXECUTED COMMERCIAL SURVEYS, LIABILITY CAPS, FIELD WARRANTIES, AND INDEMNITY ARE CONTROLLED EXCLUSIVELY BY THE EXECUTED MASTER SERVICES AGREEMENT.
You agree to defend, indemnify, and hold harmless ALBOWA and its subsidiaries from and against any loss, damage, liability, claim, or demand (including reasonable legal fees) made by any third party arising out of your breach of these Terms, unauthorized extraction of website assets, or violation of third-party rights.
Governing Law, Arbitration & Legal Notice
These Terms, their interpretation, and any disputes arising out of your use of this Website shall be governed by and construed in accordance with the laws of the State of Delaware (United States) or the applicable territorial jurisdiction of ALBOWA’s principal corporate seat, without giving effect to any principles of conflicts of law.
Any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof shall be resolved exclusively through final and binding arbitration administered by the American Arbitration Association (AAA) or equivalent recognized international tribunal. You waive any right to participate in a class action lawsuit or class-wide arbitration against ALBOWA.
If any provision of these Terms is held to be invalid or unenforceable, such provision will be severed, and the remaining provisions will remain in full force and effect.
